Your continued use of our website and/or services after such changes will be deemed confirmation that you accept those changes.

Payments
​
When you provide your payment details and confirm this payment at https://checkout.stripe.com/, you also confirm your subscription with The Poleground. Upon payment, you confirm (A) that you have read the terms and conditions and (B) that you are aware that you are entering into an agreement with recurring charges.
By confirming your subscription, you authorize The Poleground to charge for this payment and future payments in accordance with the terms and conditions. You agree to stripe sending notifications about charges at least 2 days before the execution of future charges.
By submitting your IBAN for a SEPA direct debit and confirming this payment, you authorize (A) The Poleground and Stripe, our payment service provider and/or PPRO, to send an instruction to your bank to debit your account and to ( B) debit your bank from your account in accordance with the conditions of the chosen subscription.
If you choose to pay with IDEAL, you authorize (A) The Poleground and Stripe, our payment service provider, and/or PPRO, Stripe's local service provider, to send an instruction to your bank to withdraw the amount from your account. and (B) you authorize your bank to debit your account in accordance with the terms and conditions of the chosen subscription.
If you choose to pay by credit card, you authorize The Poleground to charge this payment and future payments to your card in accordance with the terms of the chosen subscription.

If the payment already made is reversed, the costs that Stripe charges will be recovered from us, which is why we charge € 8.50 per charge-back.

Register & Participate in Lessons
​
Registration and collection forms must be completed in full.
With the (online) registration and/or payment for a lesson, the customer agrees to the general terms and conditions as formulated here. In the event of non-compliance with the general terms and conditions, The Poleground may refuse to provide services to the customer.
When you participate in your first (trial) lesson, your email address is automatically added to a mailing list, so that you receive personally oriented information about our services. If this is not desired, you can unsubscribe from this mailing list. If you indicate that you are not interested in our services, we will regard this as an unsubscribe from this mailing list.
Participation in the lesson of The Poleground is entirely at the customer's own risk. By agreeing to the general terms and conditions, the customer indicates that he is aware of the deductible and accepts this. The Poleground is not liable for injury/damage as a result of following a lesson.
The customer is responsible for the correct sportswear. The Poleground will inform the customer in advance of suitable clothing.
The customer must be ready changed at the agreed time. If this is not the case, the lost time will be deducted from the lesson time.
Loss or damage caused to property (movable and immovable property) of The Poleground and/or the owner of the location to be used by the fault of a customer will be recovered at all times.
The Poleground will do everything it can to ensure that the lesson continues according to plan/appointment. In the unlikely event that the lesson cannot take place, The Poleground will contact the customer before the start of the lesson to inform them of the cancellation. In the event of cancellation of a full course due to too few participants, a refund of the tuition fees already paid will be made. In case of force majeure situations, consultation will take place about restitution of (part of) the tuition fee.
The Poleground provides good qualified instructors and if the permanent instructor drops out, good replacements. There is no guarantee that you will always be taught by the instructor indicated on the schedule.
The Poleground reserves the right to refuse customer(s), or to stop the lesson, in case of inappropriate behavior.
The customer always informs the instructor of any injuries before the start of the lesson so that the physical load can be adjusted.
The Poleground reserves the right to change schedules and class times. Students should take into account (the progression to) the different lesson levels, which are given on different days and times. The Poleground reserves the right to refuse a customer's reservation if the customer's level does not match the level of the relevant lesson.

Verkoop- & Leveringsvoorwaarde van The Poleground Store

In deze Verkoop- en Leveringsvoorwaarden hebben de volgende termen de volgende betekenis:

"Koper" verwijst naar de natuurlijke persoon, rechtspersoon of entiteit die producten of diensten aanschaft van via de webshop van The Poleground.

"Producten" verwijst naar alle goederen, materialen of producten die door The Poleground worden aangeboden voor verkoop via de webshop (www.thepoleground.nl/store).

De Verkoop- & leveringsvoorwaarden van de webshop zijn van toepassing op alle aanbiedingen, bestellingen en overeenkomsten tussen de webwinkel en de klant. Afwijkingen van deze voorwaarden zijn slechts geldig indien deze schriftelijk zijn overeengekomen tussen de webwinkel en de klant.
Alle prijzen op de website van de webwinkel zijn vermeld in Euro's en zijn inclusief BTW, tenzij anders aangegeven. Alle aanbiedingen van de webwinkel zijn vrijblijvend en onder voorbehoud van beschikbaarheid van de producten. De klant dient de bestelling nauwkeurig te controleren alvorens deze te bevestigen. Fouten in de bestelling dienen direct aan de webwinkel te worden gemeld.

Betaling dient te geschieden voor de verwerking van de bestelling, tenzij schriftelijk anders overeengekomen. Bij niet-tijdige betaling is de Koper van rechtswege in verzuim en heeft The Poleground het recht om wettelijke rente en incassokosten in rekening te brengen.
Productinformatie
The Poleground store streeft ernaar om accurate en volledige informatie te verstrekken over de aangeboden producten, inclusief prijzen, specificaties en beschikbaarheid. Eventuele fouten of onvolledigheden in de productinformatie zijn echter niet bindend voor de Winkel.

De webwinkel zal de producten met de grootst mogelijke zorg verpakken en verzenden naar het door de klant opgegeven afleveradres. Eventuele leverings- en verzendkosten zullen aan de Klant worden gecommuniceerd en dienen te worden betaald zoals aangegeven. Het risico van verlies of beschadiging van de producten gaat over op de Klant op het moment van levering.
The Poleground spant zich in om de vermelde leveringstermijnen zo goed mogelijk na te komen, maar overschrijding van de leveringstermijn geeft de Koper geen recht op schadevergoeding of ontbinding van de overeenkomst, tenzij schriftelijk anders overeengekomen
Garantie
The Poleground Store staat in voor de deugdelijkheid en kwaliteit van de geleverde producten en biedt garantie op de verkochte producten conform de wettelijke bepalingen. De Koper heeft het recht om binnen 14 dagen na levering, indien de producten de hieronder genoemde gebreken vertonen, deze te retourneren en te laten vervangen of repareren door The Poleground Store, leverancier of aangewezen derde partij.
De garantie dekt fabricagefouten en defecten die optreden onder normaal gebruik. De garantie is niet van toepassing op normale slijtage, schade veroorzaakt door onjuist gebruik of ongevallen. De garantie vervalt indien de Koper zelf wijzigingen of reparaties aan de producten heeft uitgevoerd.
De Klant dient eventuele garantieclaims schriftelijk in te dienen en het retourbeleid van te volgen.

Retourbeleid
​Als je je bestelling wilt ruilen of retourneren, staan we altijd klaar om je te helpen! Je kunt onze producten binnen 14 dagen ruilen of retourneren. Afhankelijk van de situatie krijgt u in ruil voor het geretourneerde product een tegoedbon, een ander product of je geld terug.

Winkeltegoeden, kortingscodes en cadeaubonnen zijn niet-restitueerbaar.

Artikelen gekocht in de aanbieding kunnen alleen worden geruild voor tegoedbon.

Retourprocedure
​Binnen 14 werkdagen na ontvangst kunt u de producten retourneren.​ Als u de bestelling wilt retourneren, vragen wij u om ons hiervan binnen 14 dagen na ontvangst van uw bestelling op de hoogte te brengen. Dit kunt u doen door een email te sturen naar store@thepoleground.nl waarin u vermeld dat uw bestelling retour komt. Vermeld hierin waarom u wilt ruilen / retourneren en uw n.a.w. gegevens.

De producten dienen dan wel in originele staat aan ons geretourneerd te worden. Dit betekent: de producten mogen niet gebruikt zijn en dienen in originele verpakking te zitten. We accepteren een retour aanvraag wanneer deze voldoet aan de volgende voorwaarde:

Alle kaartjes moeten nog aan het item zitten en het item moet in de originele verpakking geretourneerd worden.

De items mogen geen zichtbare gebruikssporen vertonen.
-
Op maatgemaakte en gepersonaliseerde items kunnen niet worden geretourneerd.
De kosten voor het retourneren zijn voor de klant. The Poleground zal het bedrag van de artikelen binnen 10 werkdagen na ontvangst terug op uw rekening.

Aanbiedingen
Vouchers die door de Verkoper gratis worden uitgegeven, voor een bepaalde geldigheidsduur in het kader van promotionele activiteiten en die niet door de Klant kunnen worden gekocht (hierna "campagnevouchers" genoemd), kunnen alleen worden ingewisseld in de online shop van de Verkoper en alleen binnen de aangegeven tijdsperiode.
​
Individuele producten kunnen worden uitgesloten van de vouchercampagne, indien een dergelijke beperking voortvloeit uit de voorwaarden van de campagnevoucher.
Er kan slechts één campagnevoucher per bestelling worden ingewisseld.
De waarde van de goederen moet ten minste gelijk zijn aan het bedrag van de campagnevoucher. De Verkoper zal de resterende activa niet terugbetalen.
Indien de waarde van de campagnevoucher niet voldoende is voor de bestelling, kan de Klant kiezen voor een van de resterende betaalmethoden die door de Verkoper worden aangeboden om het verschil te betalen.
​
Het tegoed van de campagnevoucher wordt niet ingewisseld in contanten en is niet onderhevig aan enige rente.
​
Campagnevouchers zijn niet restitueerbaar, indien de Klant, de bestelling annuleert of goederen retourneert die geheel of gedeeltelijk zijn betaald met een campagnevoucher.
​
Indien de klant goederen retourneert en daarmee niet meer voldoet aan de voorwaarde van de gebruikte campagnevouchers en/of aanbiedingen, zal een nieuwe factuur worden opgemaakt zonder de eerder verkregen korting.​
​
Privacybeleid
The Poleground Store verzamelt en verwerkt persoonlijke gegevens van de Klant in overeenstemming met het toepasselijke privacybeleid en de geldende wetgeving inzake gegevensbescherming. De Klant stemt in met het verzamelen, gebruiken en verwerken van persoonlijke gegevens zoals beschreven in het privacybeleid van de The Poleground.

Aansprakelijkheid
De webwinkel is niet aansprakelijk voor enige schade die voortvloeit uit het gebruik van de producten of diensten, tenzij deze schade is veroorzaakt door opzet of grove nalatigheid van de webwinkel. De totale aansprakelijkheid van de webwinkel is beperkt tot het bedrag dat door de verzekering van de webwinkel wordt gedekt. De totale aansprakelijkheid bij verlies van een product is beperkt tot het bedrag van de aankoopprijs van het betreffende product.

Levering van diensten en/of producten op aanvraag

OFFERTES EN OVEREENKOMSTEN
Alle offertes van The Poleground zijn vrijblijvend en geldig voor de in de offerte aangegeven termijn.
​
The Poleground behoudt zich het recht voor om een opdracht te weigeren of aanvullende voorwaarden te stellen voordat de diensten worden uitgevoerd.
​
​Een overeenkomst komt tot stand op het moment dat de Klant akkoord gaat met de offerte van The Poleground, en The Poleground deze akkoordverklaring schriftelijk of elektronisch bevestigt. De opdrachtgever is verplicht voor de totstandkoming van de overeenkomst alle persoonlijke omstandigheden van zichzelf en/of deelnemers aan The Poleground te melden voor zover deze van invloed kunnen zijn op een goed verloop van de Dienst. Deze verplichting geldt met name voor alle relevante medische en conditionele bijzonderheden.

De prijzen op offerten en facturen gelden in principe per persoon, tenzij uitdrukkelijk anders is vermeld. De totaalprijs van de factuur of offerte omvat alle de diensten en voorzieningen die op de offerte of factuur zijn omschreven.
​
Indien gewenst kan de overeenkomst voor de uitvoeringsdatum worden gewijzigd. Dit echter tot een termijn van 30 dagen voor aanvang van de overeenkomst. Partijen treden dan tijdig met elkaar in overleg om de overeenkomst dienovereenkomstig aan te passen. Bij een wijziging van de overeenkomst wordt indien nodig wijzigingskosten in rekening gebracht onverlet de eventuele meerkosten als gevolg van de wijziging.

De prijzen op offerten en facturen gelden in principe per persoon, tenzij uitdrukkelijk anders is vermeld. De totaalprijs van de factuur of offerte omvat alle de diensten en voorzieningen die op de offerte of factuur zijn omschreven. De opdrachtgever dient er rekening mee te houden dat prijzen per persoon worden bepaald op basis van de kosten die worden gemaakt om de dienst te leveren. Wijzigingen in de overeenkomst kunnen invloed hebben op kost prijs per persoon.
​
Indien de overeenkomst tot stand komt binnen 14 dagen voor aanvang is de opdrachtgever verplicht het bedrag van de overeenkomst in één keer te voldoen binnen drie dagen nadat de overeenkomst is gesloten, tenzij uitdrukkelijk en schriftelijk anders is overeengekomen. Indien de overeenkomst tot stand komt binnen 7 dagen voor aanvang dient opdrachtgever het bedrag onmiddellijk doormiddel van aangeleverde betaallink te betalen, zodat op moment van het in roosteren van het personeel zichtbaar betaald is.

ANNULEREN & RESTITUTIE
Bij annulering door de opdrachtgever is hij in ieder geval het volgende verschuldigd aan de
The Poleground:
a. Tot 30 dagen voor aanvang: 60% van de prijs van de dienst;
b. Tot 14 dagen voor aanvang: 80% van de prijs van de dienst;
c. Binnen 7 dagen voor aanvang: 100% van de prijs van de dienst. Dit geldt ook indien de deelnemer zonder te annuleren niet aanwezig is bij aanvang van de dienst.
Tevens is en blijft de opdrachtgever bij annulering verschuldigd:
​a. Reeds gemaakte loonkosten die nodig waren voor het leveren van de dienst
b. Compensatie voor reeds gemaakte materiaalkosten
c. Aan The Poleground gefactureerde diensten en producten door derde partijen.
​​
OVERMACHT
In geval van overmacht, zoals natuurrampen, stakingen, brand, overheidsmaatregelen of andere onvoorziene omstandigheden, is The Poleground niet gehouden zijn verplichtingen na te komen. In dat geval heeft The Poleground het recht om de overeenkomst te ontbinden zonder schadevergoeding verschuldigd te zijn.
